Welcome to Align — your portal for easy electronic collaboration on all your firm’s litigation matters (the “Platform”). This privacy policy (“Privacy Policy”) explains how information is collected and used in the Platform, which is developed and supported by MFB Technologies, Inc. (“MFB” or “we”, “us”, “our”). It also explains how information is collected and used when you use “Align Research”, our SaaS legal research product.
Important: If you use Align Research under a free tier (unpaid) plan, your research questions and our responses will be used to improve our AI models and retained indefinitely. Paid users' questions and resulting responses are not used for AI training.
We are committed to protecting and respecting data privacy, and we encourage you to read this Privacy Policy.
The model in which we develop and support the Platform is simple: we do not want to have access to the litigation content and materials that users upload to or post on the Platform (“Firm Content”) unless brief access is necessary to provide you technical support. Therefore, the law firm hosts the Platform on its local servers, or through their own Microsoft Azure tenant. We are not in the business of hosting the Firm Content.
Align Research, on the other hand, is a SaaS product that transmits and processes information to and on the cloud.
The Platform processes the name and email address of each member of the firm who uses the Platform or Align Research (the “Firm” and “Users”). When we audit the Platform licenses that the law firm purchased and uses, we may collect from the law firm the names of Users, email addresses, positions, and their law firm affiliation.
If a User signs in to Align Research using Google as an identity provider, Align Research also receives the User’s email address and the User’s display name from their basic profile information associated with their Google account. Align Research does not request access to a User’s Google account beyond the limited scopes described above and does not access a User’s Google email content, contacts, calendar, files, or other Google account data not expressly made available through those scopes
When a User logs on to the Platform's iPad app using a version of our app that is not under Mobile Device Management or Mobile Application Management control (“non-MDM/MAM version”), we receive the User's name, email address, and law firm affiliation. The Firm controls whether or not Users are able to access the Platform using the non-MDM/MAM version of our app.
Align Research processes User account and access credentials information, as well as payment information for registration and the purchase of processing credits to run queries on Align Research.
We refer to this data as “User Account Information”.
Users upload and post Firm Content to and on the Platform. The Firm Content can include binders, notes, annotations, the names of matters, the names of clients, and information about individuals associated with a matter.
MFB does not determine or control the Firm Content. It is determined and controlled exclusively by the Firm and its Users.
Because the Firm hosts the Platform on its local servers, or through its own Microsoft Azure tenant, we do not host this data. We also do not have access to the data unless brief access is necessary, and the Firm enables it so that we can provide you with technical support. Align Research operates differently: because it is a cloud-based SaaS product, we host and have access to Questions and Responses, User Account Information, and Analytics Information processed through Align Research.
The Platform collects certain information about how Users interact with the Platform, such as the settings and configuration options the User select on the Platform, and the actions the User takes while using the Platform (e.g., authoring a document, accessing a document, annotating a document). We refer to this as “Analytics Information". Analytics Information is anonymized and does not contain User Account Information or Firm Content. We do not receive Analytics Information unless the Firm consents to provide it.
When an Align Research User submits a research question, the question is transmitted to and processed in our cloud to provide the user with highlighted cases relevant to the question (“Questions and Responses”).
Align Research also collects certain information regarding how Users interact with Align Research, such as the settings and configuration options Users select on Align Research and the actions Users take while using Align Research. We also refer to this as “Analytics Information.”
When one of the Firm’s designated technical support representatives (“Technical Support Representative”) contacts us with a technical or service support inquiry regarding the Platform or Align Research, we process the name and email address of the Technical Support Representative, and the content of technical support or service inquiry. Depending on the nature of the technical support issue, the content of the inquiry may include some User Account Information, Firm Content, Questions and Responses or Analytics Information, if the Technical Support Representative chooses to provide to us, or gives us access to it, for the purpose of troubleshooting the issue. In case of Align Research, we can access this information independently. We refer to this data as “Technical Support Data”.
Where a User elects to log in using Google, Align Research uses Google OAuth2 solely to authenticate the User to the service, verify the User’s identity and access rights, associate the User with the correct account and authorized resources, display a personalized experience such as the User’s name and settings, and send service-related and product-related emails to the User’s email address.
We will process personal information with the assistance of our contractors who help us to provide User support and troubleshooting. These contractors are authorized to use the Technical Support Data only in this context and only as necessary to provide support, and not for any other purpose.
If you abused your rights to use the Platform, or violated any applicable law, we will share Technical Support Data and User Account Information with your Firm and authorities and with third parties (such as legal counsels and advisors), for the purpose of handling of the violation or breach.
We will share Technical Support Data if we are required to do so under law.
If the operation of our business is organized within a different framework, or through another legal structure or entity (such as due to a merger or acquisition), we will share Technical Support Data, Analytics Information, Questions and Responses (for Align Research users), and User Account Information only as required to enable the structural change in the operation of the business.
We will retain the Technical Support Data for the brief duration needed to provide the technical support requested. Thereafter, we will discard the Technical Support Data, unless we need to retain it to comply with legal obligations, resolve disputes, establish, and defend legal claims and enforce our agreements.
Users may request deletion of their Align Research account data by cancelling their account or by contacting us through the support or contact details provided in this Privacy Policy. After a valid deletion request or account cancellation, we will delete or de-identify the account, including the Google-provided account information, except where retention is required or permitted by applicable law.
We will retain User Account Information for the duration of the agreement with the law firm, and thereafter for recordkeeping purposes, to resolve disputes, to establish, and defend legal claims and to enforce our agreements.
For Align Research Users who sign in with Google, we retain the Google-provided email address and profile information for as long as the User maintains an account with Align Research, and we delete such information within 30 days after the User cancels the account, unless a longer retention period is required by law or reasonably necessary for recordkeeping (including bookkeeping and retention of transaction records), to resolve disputes, establish or defend legal claims, or enforce our agreements.
We will retain Analytics Information for the duration for the agreement with the law firm, and thereafter only to the extent necessary to maintain or improve the performance of the Platform.
If you are an Align Research User under a free tier (unpaid) plan, we retain Questions and Responses for an extended period also after the end of our relationship with you.
We implement measures to reduce the risks of damage, loss of information and unauthorized access or use of information. However, these measures do not provide absolute information security.
From time to time, we may change this Privacy Policy. If we do so, we will make efforts to proactively notify you of such changes if we have your email address. In any event, the latest version of the Privacy Policy will always be accessible at https://align.lawyer/legal/app-privacy-policy
